1. Seller identification


These general terms and conditions of sale are offered by
NM Automotive, a simplified joint-stock company (SASU) registered with the Nancy Trade and Companies Register, with a capital of €10,000, operates the FroggyParts online store accessible at the address https://froggyparts.com.

2. Scope

These General Terms and Conditions govern the sales of new automotive parts and equipment concluded remotely between NM Automotive and any customer making a purchase on the FroggyParts online store.

These terms and conditions apply to the exclusion of all other conditions, unless expressly agreed to in writing by NM Automotive. The Customer acknowledges having read these Terms and Conditions before validating their order.

3. Products

The products offered for sale are those appearing on the Site on the day of consultation, within the limits of available stock or supply possibilities.

Each product is accompanied by a description outlining its essential characteristics. Photographs and visuals are provided for illustrative purposes only and are not contractually binding.

The Customer is solely responsible for selecting products, including their compatibility with the vehicle, the intended use, and applicable technical specifications. If in doubt, the Customer should contact NM Automotive before placing any order.

The Customer is also responsible for the assembly, installation and use of the parts sold, which must be carried out in accordance with the recommendations of the vehicle manufacturer and best practices, by a person with the necessary technical skills.

The Seller shall not be held liable for damages resulting from incorrect assembly, improper use, modification of the part, failure to comply with the manufacturer's instructions or use of the part on a vehicle for which it is not intended.

4. Geographic area of sale and delivery


The shop is intended for customers located in France and in European Union countries for which delivery is offered at the time of order. Certain destinations or delivery methods may be excluded depending on the nature of the products, their weight, their volume, logistical constraints, or the carriers' policies.

5. Price

The prices displayed on the Site are in euros. Unless otherwise stated, they include all taxes where applicable, excluding any delivery, packaging or preparation charges that may be billed separately.

The applicable delivery charges are indicated before final order confirmation.

NM Automotive reserves the right to change its prices at any time. Products are billed based on the price in effect at the time the order is validated.

6. Order

The customer selects the desired products and adds them to their basket. Before final validation, they can check the details of their order, its total price, correct any errors, and modify the quantities or contents of the basket.

The order is only definitively registered after validation of the order summary, express acceptance of these Terms and Conditions, and confirmation of the payment obligation by the Customer via the mechanism provided on the Website. Creating an account is not mandatory.

A confirmation email summarizing the order is sent to the Customer at the email address provided during the purchase.

NM Automotive reserves the right to refuse or cancel any order in the event of a prior dispute, failure to pay, suspicion of fraud, manifestly erroneous information or legitimate reason relating to product availability.

7. Availability


Product offers are valid as long as they are visible on the Website and while stocks last. If a product becomes unavailable after an order has been placed, the Customer will be informed as soon as possible. The order may then be cancelled in whole or in part, and any sums paid for unavailable products will be refunded without undue delay.

8. Payment

Orders are paid for by bank card (via the secure Stripe platform), by PayPal account, or by any other means of payment expressly offered on the Site when validating the shopping cart.

The price is due in full at the time of ordering, unless otherwise stated on the Website. The order is processed only after payment has been confirmed.

Payments made on the Site are secured by the relevant service providers. NM Automotive does not have access to the Customer's full bank details when the payment is processed by a specialized third-party provider.

9. Delivery

Deliveries are made to the address indicated by the Customer when placing the order, provided that it is located in an area served by the carriers offered on the Site.

Deliveries are provided by various partner carriers (including, in particular, via the Boxtal shipping solution: Mondial Relay, Colissimo, Chronopost, or any other carrier selected by the Seller), depending on the destination, weight, dimensions of the package and the options chosen by the Customer when ordering.

The applicable delivery time is that indicated at the time of the order. Unless otherwise specified, delivery will take place without undue delay and at the latest thirty days after the conclusion of the contract.

The seller reserves the right to make deliveries in full or in part. In the case of a partial delivery, the available goods will be shipped first. The remainder of the order will be shipped later, upon receipt of the missing stock. The customer may not use a partial delivery as grounds for demanding cancellation of their entire order or any compensation. If the seller decides on a partial delivery, the additional shipping costs for sending the remaining items will be borne exclusively by the seller.

The Customer is required to check the apparent condition of the package and the product upon receipt and to report any obvious anomaly or damage without delay. This check does not deprive the Customer of their rights under legal guarantees.

10. Risk Transfer


The risk of loss or damage to the product is transferred to the consumer customer at the moment when he or a third party designated by him other than the carrier takes physical possession of the product.

11. Right of withdrawal

When the Customer qualifies as a consumer under the Consumer Code, they have a period of fourteen days to exercise their right of withdrawal without having to justify their decision. For contracts for the sale of goods, this period begins upon receipt of the goods by the Customer or by a third party designated by them, other than the carrier.

To exercise their right of withdrawal, the Customer may send NM Automotive any unambiguous statement expressing their intention to withdraw, by mail to the company's registered office address or via this form.

The Customer shall return or hand over the goods without undue delay and at the latest within fourteen days of communicating their decision to withdraw, to the registered office address.

The item must be returned complete, in its original condition, with:

  • its possible accessories,
  • its possible instruction manual,
  • its label,
  • its original packaging.

The Customer is informed that their liability may be incurred in the event of depreciation of the part resulting from handling other than that necessary to verify its nature, characteristics and apparent compatibility.

Parts showing signs of assembly, use, disassembly, deterioration, modification or alteration of their safety packaging may be subject to a reduction in reimbursement proportional to their loss of value, in accordance with applicable legal provisions.

Electronic parts, computers, programmable modules or any other component that has been coded, programmed, configured or modified specifically for a vehicle may be excluded from the right of withdrawal when the legal conditions for exclusion are met.

Unless otherwise agreed by NM Automotive, The direct costs of return shipping remain the responsibility of the Customer.

Given the nature of some products sold on FroggyParts (such as hoods, bumpers, engines, or gearboxes), these items cannot normally be returned via standard courier services (La Poste, Mondial Relay, etc.). The customer must therefore use a specialized carrier. As a guide, the return cost for a large part (e.g., a Twingo hood) is estimated to be between €60 and €150 including VAT, depending on the distance and the chosen carrier. It is the customer's responsibility to arrange and pay for this transport.

In the event of a valid cancellation, NM Automotive will reimburse all payments received from the Customer, including any standard delivery charges, no later than fourteen days from the date on which it is informed of the decision to cancel. NM Automotive may withhold reimbursement until it has received the goods back or until it has supplied evidence of having sent the goods back, whichever is the earliest.

The refund will be made using the same payment method as the initial transaction, unless the Client expressly agrees otherwise and provided that no additional costs result for them.

12. Exceptions to the right of withdrawal


In accordance with the Consumer Code, the right of withdrawal cannot be exercised for goods made to the Customer's specifications or clearly personalized, nor for other legally excluded circumstances.

13. Legal Guarantees

The consumer benefits from the legal guarantee of conformity and the legal guarantee against hidden defects, under the conditions provided by law.

The seller must deliver goods that conform to the contract and to the legal standards of conformity. The seller is liable for any lack of conformity existing at the time of delivery and appearing within two years of delivery.

The consumer can invoke the legal guarantee of conformity within two years of delivery of the goods. They can choose between repair and replacement of the goods, subject to the cost conditions stipulated by law. They can obtain a price reduction or cancellation of the contract in the cases provided for by law.

The consumer also benefits from the legal guarantee against hidden defects, pursuant to Articles 1641 et seq. of the Civil Code. In this context, they can choose between rescinding the sale or obtaining a price reduction, in accordance with the law.

These legal guarantees apply independently of any commercial guarantee that may be granted.

In the event of an alleged defect affecting a sold part, the Customer is invited to submit their request using this method. form, accompanied by any information useful for the investigation of the case, including photographs, description of the defect, part reference and order number.

After receiving the request, the Seller will conduct a preliminary analysis of the file and may request any additional information necessary for its processing.

When the review of the file justifies it, the Seller informs the Customer of the return procedure for the part, as well as a file number or return authorization number. No returns should be made without these prior instructions.

  • In the event of a shipping problem, it is necessary to return the complete part to us, carefully protected in its original box, all placed inside a shipping box, along with:
    • its original state,
    • its possible accessories,
    • its possible instruction manual,
    • any other item supplied with the goods.
    • our return voucher.
  • In the event of a failure during the warranty period, it is necessary to return the part to us, carefully protected, in a shipping box, accompanied by our return slip.

Receipt of the part does not constitute acknowledgment of the warranty coverage for the alleged defect. The part may be subject to a outsourced expertise, intended to verify the existence of a lack of conformity, its origin and the conditions for application of the legal guarantee.

If the conditions of the legal guarantee of conformity are met, the Customer will benefit from the rights provided for by the legal provisions in force, in particular the repair or replacement of the part, or, in cases provided for by law, the reduction of the price or the cancellation of the sale.

14. Customer service – complaints

For any questions, complaints, return requests, or warranty claims, the Customer may contact NM Automotive by mail at the head office address or via this form.

15. Consumer mediation

After first making a written request to NM Automotive, the consumer may resort free of charge to the competent consumer mediator if the dispute could not be resolved amicably.

16. Force majeure


NM Automotive cannot be held liable for the non-performance or delay in the performance of its obligations when such non-performance or delay results from a case of force majeure within the meaning of French law.

17. Intellectual Property


All elements of the Site remain the exclusive property of NM Automotive or their respective owners. No transfer of rights is granted to the Client under this agreement.

18. Applicable Law – Disputes

These Terms and Conditions are governed by French law.

In the event of a dispute, the consumer Client may bring the matter before either one of the courts with territorial jurisdiction under the code of civil procedure, or the court of the place where he resided at the time of the conclusion of the contract or the occurrence of the harmful event.
